Terms and conditions

The terms that apply to all services of Kyzoe Hosting & Design. Version of 27 September 2026.

This is an English translation for information purposes. The Dutch version of these terms and conditions is legally binding; in case of any discrepancy, the Dutch version prevails.

Hereinafter referred to as: “Kyzoe Hosting” or “Kyzoe”

Article 1 – Definitions

In these General Terms and Conditions the following terms mean:

  • Account: the Client’s personal online management environment.
  • Subscription: an agreement under which Services are provided for a fixed period, with the exception of domain names.
  • General Terms and Conditions: this document.
  • Services: all products and services offered by Kyzoe Hosting, including but not limited to hosting, domain registration and related services.
  • Materials: all works and data developed or made available by Kyzoe Hosting.
  • Client: the natural or legal person who concludes an Agreement with Kyzoe Hosting.
  • Agreement: any agreement between Kyzoe Hosting and the Client.
  • SLA (Service Level Agreement): a separately agreed service level in writing.
  • Data Processing Agreement: the agreement on data processing in accordance with the GDPR.
  • In writing: communication by letter or email.

Article 2 – Formation of the agreement

  1. The Agreement is concluded at the moment Kyzoe Hosting confirms the Client’s request in writing (whether or not automatically).
  2. When the Agreement is concluded, a Data Processing Agreement is automatically deemed to have been concluded, where applicable.
  3. The General Terms and Conditions always apply in full.
  4. Consumers have, subject to exceptions, a right of withdrawal of 14 days. Domain names are excluded from this.

Article 3 – Performance of the agreement

  1. Kyzoe Hosting will perform the Services to the best of its ability.
  2. No guarantees are given regarding availability or performance, unless laid down in an SLA.
  3. Kyzoe Hosting may carry out maintenance without liability for temporary interruptions.
  4. Deadlines are indicative, unless otherwise agreed in writing.
  5. Kyzoe Hosting may engage third parties in performing the Services.
  6. Actions via the Account are entirely the responsibility of the Client.

Article 4 – Obligations of the Client

  1. The Client provides all necessary information in good time.
  2. The Client may not use the Services for high-risk applications.
  3. The Client is responsible for permits and legal obligations.
  4. Backups:
    • Kyzoe Hosting makes daily backups of automatically created websites (15 days retention).
    • The Client remains fully responsible for backups and recovery.
    • Kyzoe Hosting is not liable for failing backups or plugins.

Article 5 – Rules of conduct & Notice-and-Takedown

It is prohibited to use the Services for, among other things:

  • illegal activities;
  • hateful, discriminatory or defamatory content;
  • malware, spam or copyright infringement;
  • child pornography or bestiality.

In the event of complaints or violations, Kyzoe Hosting is entitled to block access and, if necessary, report to the authorities.

Article 6 – Resellers

  1. Reselling is permitted under the reseller’s own name and responsibility.
  2. The Client indemnifies Kyzoe Hosting against claims from end customers.
  3. Licences and discounts apply exclusively to domains hosted by Kyzoe.

Article 7 – Domain names

  1. Kyzoe Hosting acts as an intermediary.
  2. Registration depends on external bodies.
  3. No liability in the event of failed registration.
  4. In the event of non-payment, Kyzoe Hosting may temporarily block or terminate domains.

Article 8 – Storage and data traffic

  1. Exceeding limits may be charged.
  2. For “unlimited”, Fair Use applies.
  3. External causes (such as DDoS) may be charged on.

Article 9 – Intellectual property

All intellectual property rights are vested in Kyzoe Hosting or its licensors, unless otherwise agreed in writing.

Article 10 – Prices

  1. All prices include VAT.
  2. Kyzoe Hosting may change prices for subscriptions.
  3. Additional support outside the scope is invoiced at an hourly rate.

Article 11 – Payment terms and late payment

  1. Kyzoe Hosting invoices the amounts owed by the Client electronically, unless otherwise agreed in writing. Invoices are payable in advance and must be paid within the payment term stated on the invoice.

  2. If no specific payment term has been agreed, a payment term of 14 calendar days after the invoice date applies.

  3. If the Client does not pay on time and in full, the Client is in default by operation of law and without notice of default.

  4. In the event of late payment, Kyzoe Hosting will send one free payment reminder to the email address recorded in its administration systems.
    For each subsequent reminder an administrative fee of €10 may be charged. These costs must be paid in full before suspended Services are reactivated.

  5. If payment is not made after the first payment reminder, the Client owes, in accordance with Belgian law, a fixed compensation as follows:

    • €20 if the amount owed is less than or equal to €150;

    • €30, plus 10% of the amount owed above €150, if the amount owed is between €150 and €500;

    • €65, plus 5% of the amount owed above €500, with a maximum of €2,000, if the amount owed is more than €500.

  6. In addition, the Client owes statutory interest:

    • for consumers: the statutory interest rate as determined by law;

    • for non-consumers: the interest rate in accordance with the Act on combating late payment in commercial transactions.

  7. As long as the Client is in default, Kyzoe Hosting is entitled to:

    • suspend the Services in whole or in part, without prior warning;

    • make websites, email services and other Materials inaccessible;

    • only reactivate after full payment of outstanding amounts, interest and costs.

  8. Unless the Client is a consumer, any reliance on suspension, set-off or netting is expressly excluded.

  9. If Kyzoe Hosting is obliged to hand over a claim for collection, all judicial and extrajudicial collection costs are borne in full by the Client.

  10. Non-payment or late payment by the Client’s customers (in the case of reselling) does not release the Client from its payment obligations towards Kyzoe Hosting.

Article 12 – Liability

  1. Liability is limited to the amount paid by the Client (excl. VAT).
  2. No liability for indirect damage or loss of profit.
  3. Claims lapse after 12 months.

Article 13 – Force majeure

No liability in the event of force majeure, including network failures, cyber attacks, strikes or government measures.

Article 14 – Confidentiality

Both parties treat confidential information as strictly confidential, also after termination.

Article 15 – Personal data

  1. Kyzoe Hosting is the processor, the Client the controller.
  2. The Data Processing Agreement forms an integral part of the Agreement.
  3. The Client indemnifies Kyzoe Hosting against fines or claims.

Article 16 – Duration, termination and renewal

  1. Domain names are taken out for a minimum of one year.
  2. Subscriptions run for the chosen term.
  3. Early termination is not possible for a fixed term, subject to exceptions.

Article 16bis – Trial period of 30 days

  1. For new hosting plans (web hosting, WordPress hosting and VPS hosting) a trial period of 30 days applies, counting from the day on which the service is delivered.
  2. The Client can terminate the Agreement free of charge within that trial period by notifying this In writing via support@kyzoe.be.
  3. Kyzoe Hosting & Design then refunds the full amount paid for the hosting service, less the cost of the domain name or domain names registered or transferred with the order. The domain name remains the property of the Client.
  4. The trial period does not apply to licences, one-off work and other costs that Kyzoe Hosting & Design owes to third parties.
  5. The trial period applies once per Client.
  6. The statutory right of withdrawal for consumers (article 2) continues to apply in full.

Article 17 – Automatic renewal

  1. Only active if enabled by the Client.
  2. Payment takes place 45 days before the expiry date.
  3. No payment = automatic termination.

Article 18 – Manual renewal

  1. The Client is responsible for timely renewal.
  2. Renewal is only valid after full payment.

Article 19 – Data after termination

After termination, all data and accounts may be deleted immediately.

Article 20 – Changes to the terms

  1. Changes are announced 30 days in advance.
  2. If the Client refuses, the Client may terminate the Agreement.

Article 21 – Final provisions

  1. Belgian law applies to all Agreements.
  2. Disputes are submitted to the competent court of the district where Kyzoe Hosting is established.
  3. The nullity of a provision does not affect the rest.

Annex 1 – Data Processing Agreement

The Data Processing Agreement is available separately via https://kyzoe.be and forms an integral part of these General Terms and Conditions.
